ORDERS AND CANCELLATIONS
Changes to your order
If you wish to alter your order or subscription, please contact the Customer Service Team at email@example.com. We’ll always do our best to make last-minute changes for you, but we can only guarantee changes (including the delivery address and gift card message) no later than 36 business hours prior to your order going out.
Your cancellation rights
You can cancel single orders no later than 36 business hours prior to the requested delivery date. In those circumstances, a full refund will be given. If a lesser period of notice is given, we will only give a refund if we have not started preparation of your order at the time notice is given. We cannot accept cancellations for Next Day or Same Day orders.
We accept credit cards and pay upon delivery. In order to offer the best security, all our payments are processed securely by Stripe payments.
If you create an account, your card will be stored securely by Stripe so that you can check out on future visits without re-entering your card details.
We never store or have access to your credit or debit card details.
DELIVERY CHARGES AND VAT
All prices for delivery include VAT at the current rate unless otherwise stated.
Standard delivery is complimentary unless on specified dates where a charge will apply. Next Day delivery will include a charge of £4.99 and Same Day Delivery, will include a charge of £9.99.
Delivery will be made to the address specified by you when you place your order on the website. We reserve the right to restrict deliveries in certain areas, and this includes the right to eliminate certain areas from our delivery schedule altogether. We clearly list the available postcodes and areas which we deliver to on our website.
In the event that the goods delivered to you are incomplete or include incorrect goods, you must notify us within 72 business hours of your expected delivery date. You will not be charged for any incorrect goods or goods which you have not received. In any event our liability will be limited to the price of the goods not delivered or incorrectly delivered and the cost of delivery.
We take special care to endeavour that deliveries are made within your nominated delivery day and accordingly, it is your responsibility to ensure that an appropriate person is available at the delivery address at all times during the delivery slot. We may ask that an appropriate person signs for the goods on delivery. If no one is at the address when the delivery is attempted, we will either leave the goods with a neighbour or in a safe place. If these options are not available, the order will be brought back to our warehouse and our Customer Service team will contact you to rearrange the delivery.
REFUNDS AND RETURNS POLICY
Freshness and Damage
Our flower orders will often be sent out in bud form meaning they will last longer with the recipient. While our flowers are packed carefully to ensure they arrive as fresh and beautiful as when they left us, on occasions (and for reasons beyond our control) they may be damaged in transit. If you receive flowers that do not seem fresh or are damaged, please contact our Customer Service team at firstname.lastname@example.org to let us know.
If the flowers do not meet our own high standards, we will give you the choice of a free replacement at our next available delivery date, or a refund. Please note that you will need to email us a photo of the poor quality or damaged flowers within 72 hours of receipt in order to be eligible for a refund or replacement. If we offer you a refund, we will refund you the full amount within 7 business days. Please note that banks might take an additional 3-5 days to refund the amount to your card.
Please understand that due to the perishable nature of flowers, we are unable to accept returns on these products. If you wish to return any accessories, you can do so within 14 days of the date on which you place your order and we will refund to you the price you paid for the products along with the standard delivery cost for those products You will need to pay any costs associated with returning the products.
FLOWER AVAILABILITY AND SUBSTITUTION
Availability of floral products is subject to supply difficulties. Should the flowers we receive from our growers do not meet our high quality standards, we reserve the right to substitute for them at our discretion.
OFFERS AND PROMOTION CODES
We reserve the right to occasionally offer products at a discount. These discounts are only good for orders placed between the time we first make them available and their expiration date; they cannot be applied to orders placed earlier or later.
We have the right to modify or discontinue any special offers at any time and without prior notice because they are subject to availability.
We only let one promotion code to be used per order, unless otherwise specified.
With the exception of what has already been stated, we will do everything in our power to ensure that the BLOOMINGFLORIST service is uninterrupted and error-free, but we cannot guarantee it. As a result, we accept no liability for any service interruptions and shall be released from our obligations under these Terms and Conditions in the event that a factor beyond our reasonable control makes the provision of the BLOOMINGFLORIST service impossible or impractical.
In addition, BLOOMINGFLORIST will not be held liable for any business losses (such as lost earnings, revenue, contracts, anticipated savings, data, goodwill, or wasted expenditures) or indirect or consequential losses that were not foreseen by you and us at the time you started using the BLOOMINGFLORIST.
If there is a delay or failure to perform our responsibilities under these terms due to an event that is beyond our reasonable control, we shall not be held liable.
Nothing in these terms and conditions minimises or disclaims our liability for false statements we make or for any death or personal harm brought on by our carelessness or willful misconduct. Furthermore, these Terms and Conditions have no bearing on your legal rights.
We retain the right to periodically add to and change the Terms and Conditions under which you are granted access to the BLOOMINGFLORIST website and/or service. Every time a customer accesses the BLOOMINGFLORIST service or BLOOMINGFLORIST site, they are responsible for reading the Terms and Conditions, which we shall display on the BLOOMINGFLORIST site. Changes take effect five hours after they are posted, and all future transactions between you and us will be subject to the updated Terms and Conditions.
Additionally, we retain the right to at any time and for any reason, suspend, restrict, or eliminate access to the BLOOMINGFLORIST site and/or the BLOOMING FLORIST services. Any suspensions or restrictions will be limited in frequency and length, and you will be informed if they have an impact on an active subscription.
All additional notices, policies, disclaimers, and other terms included on the BLOOMINGFLORIST site shall be deemed to be a part of these Terms and Conditions, provided that these Terms and Conditions shall take precedence in the event of any inconsistency. The remaining clauses shall continue to be in full force and effect if any of these terms and conditions are found to be void or unenforceable
Any of the Terms and Conditions cannot be enforced by a third party that is not a party to the agreement between you and us.
This Agreement (including any documents and instruments referred to herein) constitutes the entire agreement and understanding between you and us with respect to its subject matter and supersedes all prior representations, agreements, understandings, and agreements (whether written or oral) with the exception of any fraudulent misrepresentation.
It will be assumed that your purchase took place in the UK. Irish law shall govern the interpretation and application of these terms and conditions, and the parties hereby consent to the non-exclusive jurisdiction of the Irish courts in all disputes.
